Sources of Personal Data

In addition to data collected directly from you, Akeneo may receive personal data from the following sources:

• Public professional platforms (e.g., LinkedIn): job title, employer, professional contact details, for B2B prospecting purposes. 
• Third-party data enrichment providers (e.g., ZoomInfo, Clearbit): company size, industry, contact information, for lead qualification purposes. 
• Business partners and resellers: contact details of their clients or prospects where they refer Akeneo’s services. 
• Publicly available sources: published professional contact information. Where Akeneo collects data from third-party sources, it will inform the data subject within a reasonable period (and in any event within one month), unless an exemption applies under applicable data protection law.

Recipients of the Collected Personal Data

With the exception of what is presented in this privacy policy or what is permitted or required by applicable law, Akeneo does not share User data with third parties without their prior authorization, and Akeneo does not allow third parties to collect personal data from Website Users. However, Akeneo may share User personal data with its third-party service providers, such as hosting and data storage service providers, to the extent necessary to provide the services requested and expected by Users. These third-party providers will only have access to information strictly necessary to fulfill their designated functions, will be subject to confidentiality and data protection obligations, and will not be authorized to use your personal data for their own commercial purposes. As the Data Controller, Akeneo will in no case be released from its obligations to Website Users due to the use of such third-party service providers.

However, Akeneo’s subsidiaries and some of its service providers are located in countries outside the EEA, and your personal data may be processed in these countries. Akeneo does not intentionally collect or process special categories of personal data (as defined in Article 9 GDPR), including data revealing racial or ethnic origin, political opinions, religious beliefs, trade union membership, health data, biometric data, or sexual orientation, through its Website or standard product use. 

If such data is inadvertently submitted (e.g., within a CV or a free-text field), Akeneo will not process it for any purpose other than responding to the original request, and will delete it as soon as reasonably practicable.

Retention Period for Personal Data

In general, your personal data will be retained only for the period necessary to achieve the purposes for which the data was collected or to comply with legal or regulatory requirements. Unless applicable exceptions apply:

• Data collected via website forms (e.g., contact requests, information requests, access to resources) are retained for as long as necessary to process the request and, where applicable, for follow-up communications or to support Akeneo’s legitimate business activities, in accordance with applicable retention requirements;.
• Data collected as part of your registration for an Akeneo event is kept until the end of the next event.
• Data collected as part of your registration to receive commercial communications or articles from Akeneo is kept until you unsubscribe.
• Data collected as part of your job application is kept for two (2) years from your last contact with us unless local legislation recommends different retention periods and unless you request the destruction of your file.
• Login data is kept for up to thirteen (13) months.
• Data collected as part of your free trial registration is kept for the duration of the trial and, where applicable, for the subsequent customer relationship, or deleted within thirty (30) days of trial expiry if no contract is entered into.

• Data collected for guest access authentication (OTP) is retained for the duration of the access session and deleted within [30] days thereafter.
• Business contact data (B2B): retained for three (3) years from the last meaningful interaction, unless the contact requests deletion earlier

Beyond these periods, Akeneo retains your data for:

• Three (3) years for data kept for prospecting purposes.
• Five (5) years for data kept for evidence.
• Ten (10) years from the close of the accounting year for data kept for accounting purposes, as well as for commercial documents.

Automated Decision-Making and Profiling

Akeneo does not make decisions about you based solely on automated processing (including profiling) that produce legal or similarly significant effects, as described in Article 22 of the GDPR. 

Akeneo may use automated tools to analyze website usage and assess lead quality for internal marketing purposes (e.g., lead scoring). Such processing does not produce legal or significant effects for the individuals concerned and is based on Akeneo’s legitimate interest in improving its commercial operations. You have the right to object to this processing at any time (see „Rights of Users“ below).

Rights of Users Regarding the Use of their Personal Data

As a user of our site, you have the right to control the use of your personal data. You have the right to access your data, allowing you to obtain clear, transparent, and understandable information about how we use your personal data and your rights (as provided in this policy), as well as a copy of your personal data. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. You have the right to object to the processing of your personal data unless there are legitimate and compelling reasons that override your interests, rights, and freedoms, such as compliance with legal obligations or the establishment, exercise, or defense of a legal right. You have the right to data portability in accordance with applicable data protection laws, allowing you to receive the personal data you provided to us. This right applies only if it meets the following conditions:

• It concerns only your personal data, excluding all anonymous data or data from third parties.
• It does not harm the rights and freedoms of third parties, including ours (especially trade secrets or intellectual property).
• It concerns personal data processed automatically (paper files are not included).

Processing is based on your consent or the performance of a contract concluded with us (to verify this, you can refer to Article 2 of this policy).
